EXHIBIT A WESTERN SIERRA MlNING CORPORATION - HERMANN DEED OF TRUST 1.All of Borrower's right, title and interest in and to the water rights and other property interests decreed in Case No. 03CW54, Wafer Division 6, State of Colorado; 2.All of Borrower's right, title and interest in and to the water rights and any right to use structures decreed to Well No. HS-JR #1 (Well Permit #66139-F) as set forth in the Final Judgment, Decree and Order executed by the Honorable Shelly Hill on May 21, 2014 as set forth in Case Number 2012CV110 as lodged in the District Court of Routt County, Colorado; 3.All of Borrower's right, title and interest in and to the water rights and structures decreed to Well No. HS-JR#2 (aka Dry Creek Well #31-1) (Well Permit #66138-F)) as set forth in the Final Judgment, Decree and Order executed by the Honorable Shelly Hill on May 21, 2014 as set forth in Case Number 2012CV110 as lodged in the District Court of Routt County, Colorado; 4.All of Borrower's right,. title and interest in and to any and all structures, water lines and tanks, storage reservoirs, facilities, fixtures, machinery, pumps, pump houses, pipe, valves, generators, equipment, apparatus and appliances, if any, used in connection with the foregoing described water rights consistent with the Decree; 5.All of Borrower's right, title and interest in and to the non-exclusive right to use the "Denker Easement" as described on that certain Water Line Easement and Agreement dated July 13, 2004 and recorded on June 1, 2005 at Reception No. 619552 of the Real Property Records of Routt County, Colorado; 6.All of Borrower's right, title and interest in and to the non-exclusive right to use the "Nereson Easement'' as described on that certain Water Line Easement and Agreement dated July 12, 2004 and recorded June I, 2005 at Reception No. 619551 of the Real Property Records of Routt County, Colorado.: 7.All of Borrower's right, title and interest in and to any and all other easements and rights-of-way or appurtenances included in, adjacent to or used in connection with the foregoing described water rights, including without limitation all existing easements across Colorado State Land Board property or any other property necessary for the use, operation, maintenance, repair or replacement of Grantor's water system; and 8.All of Borrower's right, title and interest, if any, in and to all tangible and intangible assets of any nature relating to the foregoing described water rights including by way of illustration and not limitation all plans, specifications, engineering drawings, subdivision plats, surveys, land preservation subdivision applications, prints, and similar materials relating to the foregoing described water rights.
